Aceasta poate fi extins\u0103 la 60 de ore pe s\u0103pt\u0103m\u00e2n\u0103.<br \/>\n\u00cen conformitate cu articolul L.3121-36 din Codul muncii francez, num\u0103rul mediu de ore lucrate pe s\u0103pt\u0103m\u00e2n\u0103 \u00een sectorul construc\u021biilor pe o perioad\u0103 de 12 s\u0103pt\u0103m\u00e2ni consecutive nu poate dep\u0103\u0219i 44 de ore.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]<\/p>\n<h3>Care este timpul maxim de lucru zilnic?<\/h3>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]Durata maxim\u0103 zilnic\u0103 a timpului de lucru nu poate dep\u0103\u0219i 10 ore, cu excep\u021bia cazului \u00een care se acord\u0103 derog\u0103ri \u00een condi\u021biile stabilite prin decret. Angajatul poate beneficia de o pauz\u0103 de cel pu\u021bin 20 de minute de \u00eendat\u0103 ce timpul de lucru ajunge la 6 ore. Un contract colectiv de munc\u0103 poate stabili un timp de pauz\u0103 mai lung. Aceste pauze de 20 de minute nu sunt considerate timp de lucru efectiv \u0219i, prin urmare, nu dau na\u0219tere la remunera\u021bie, cu excep\u021bia cazului \u00een care se aplic\u0103 o conven\u021bie colectiv\u0103 mai favorabil\u0103.<br \/>\nOrele suplimentare pot fi autorizate \u00een cazul \u00een care este necesar\u0103 o munc\u0103 suplimentar\u0103, \u00een special din unul dintre urm\u0103toarele motive:<\/p>\n<ul>\n<li>Lucr\u0103ri care trebuie executate \u00eentr-o anumit\u0103 perioad\u0103 de timp din cauza naturii lor, a sarcinilor impuse societ\u0103\u021bii sau a angajamentelor asumate de societate;<\/li>\n<li>Munc\u0103 sezonier\u0103 ;<\/li>\n<li>Munca care implic\u0103 o activitate sporit\u0103 \u00een anumite zile ale s\u0103pt\u0103m\u00e2nii, ale lunii sau ale anului.<\/li>\n<\/ul>\n<p>Un contract colectiv extins poate prevedea un timp de lucru zilnic efectiv maxim de 12 ore.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]<\/p>\n<h3>Care este perioada minim\u0103 de odihn\u0103?<\/h3>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]Fiecare angajat beneficiaz\u0103 de o perioad\u0103 de repaus zilnic de cel pu\u021bin 11 ore consecutive \u0219i de o perioad\u0103 de repaus s\u0103pt\u0103m\u00e2nal de 24 de ore consecutive \u00een ziua de duminic\u0103.[\/vc_column_text][vc_column_text css_animation=&#8221;fadeIn&#8221;]<\/p>\n<h3>Ce este munca de noapte?<\/h3>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]Munca de noapte este orice munc\u0103 efectuat\u0103 \u00eentre orele 21.00 \u0219i 6.00. Durata zilnic\u0103 a muncii de noapte nu poate dep\u0103\u0219i 8 ore. Durata s\u0103pt\u0103m\u00e2nal\u0103 a muncii de noapte, calculat\u0103 pe o perioad\u0103 de 12 s\u0103pt\u0103m\u00e2ni consecutive, nu poate dep\u0103\u0219i 40 de ore. O conven\u021bie colectiv\u0103 extins\u0103 poate ridica aceast\u0103 limit\u0103 la 44 de ore \u00een cazul \u00een care acest lucru este justificat de caracteristicile specifice ale activit\u0103\u021bii.<br \/>\nDe asemenea, un decret poate stabili lista sectoarelor pentru care aceast\u0103 durat\u0103 este fixat\u0103 \u00eentre 40 \u0219i 44 de ore.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]<\/p>\n<h2>Ce este echipamentul individual de protec\u021bie sau EPI?<\/h2>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;1\/2&#8243;][vc_column_text css_animation=&#8221;fadeIn&#8221;]Echipamentul individual de protec\u021bie sau EIP reprezint\u0103 o completare a m\u0103surilor colective de prevenire a riscurilor profesionale pe \u0219antierele de construc\u021bii. Rolul s\u0103u este de a reduce riscul de accidente odat\u0103 ce toate celelalte mijloace de prevenire au fost epuizate. Conform Codului Muncii (articolul R.233-83-3), defini\u021bia EIP este: &#8222;Echipamentul individual de protec\u021bie este un dispozitiv sau un mijloc destinat a fi purtat sau \u021binut de o persoan\u0103 pentru a o proteja \u00eempotriva unuia sau mai multor riscuri susceptibile de a-i amenin\u021ba s\u0103n\u0103tatea \u0219i securitatea.[\/vc_column_text][\/vc_column][vc_column width=&#8221;1\/2&#8243;][vc_single_image image=&#8221;35372&#8243; img_size=&#8221;large&#8221; alignment=&#8221;right&#8221; css_animation=&#8221;fadeIn&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]To\u021bi lucr\u0103torii din domeniul construc\u021biilor trebuie s\u0103 poarte anumite tipuri de echipamente de protec\u021bie, \u00een func\u021bie de riscurile specifice asociate cu munca lor \u0219i de riscurile specifice asociate cu \u0219antierul \u00een sine.<br \/>\nExist\u0103 3 categorii principale de echipamente de protec\u021bie :<\/p>\n<ul>\n<li>Clasa I pentru echipamente concepute pentru a proteja \u00eempotriva riscurilor minore;<\/li>\n<li>Clasa II pentru protec\u021bia \u00eempotriva pericolelor care pot provoca daune semnificative;<\/li>\n<li>Clasa III pentru riscuri cu consecin\u021be grave sau fatale.<\/li>\n<\/ul>\n<p>[\/vc_column_text][vc_column_text css_animation=&#8221;fadeIn&#8221;]EIP obligatorii sunt \u00eembr\u0103c\u0103mintea \u0219i \u00eenc\u0103l\u021b\u0103mintea de lucru:<\/p>\n<ul>\n<li>\u00cembr\u0103c\u0103mintea de lucru poate avea propriet\u0103\u021bi diferite \u00een func\u021bie de scopul urm\u0103rit. Acestea pot proteja \u00eempotriva intemperiilor, a frigului \u0219i, de asemenea, \u00eempotriva focului. \u00cen general, acestea trebuie s\u0103 fie conforme cu standardul ISO 13688.<\/li>\n<li>\u00cenc\u0103l\u021b\u0103mintea de siguran\u021b\u0103 protejeaz\u0103 picioarele \u00eempotriva riscurilor de perforare, t\u0103iere sau impact \u0219i trebuie s\u0103 fie conform\u0103 cu standardul NF ISO 201345.<\/li>\n<\/ul>\n<p>\u00cen cazul \u00een care un angajat refuz\u0103 s\u0103 poarte EIP, acesta nu numai c\u0103 se expune unor riscuri semnificative pentru s\u0103n\u0103tate \u0219i siguran\u021b\u0103, dar poate fi \u0219i concediat pentru abatere grav\u0103.<br \/>\nAngajatorii pot fi amenda\u021bi sau pedepsi\u021bi cu \u00eenchisoarea pentru c\u0103 nu ofer\u0103 angaja\u021bilor lor echipamente de protec\u021bie individual\u0103 adecvate sau pentru c\u0103 nu asigur\u0103 respectarea reglement\u0103rilor.<br \/>\nFurnizarea de EIP de c\u0103tre angajator \u0219i purtarea EIP de c\u0103tre angaja\u021bi este, prin urmare, o obliga\u021bie pentru a reduce riscul de accidente pe \u0219antierele de construc\u021bii, astfel \u00eenc\u00e2t EIP nu ar trebui s\u0103 fie neglijate.[\/vc_column_text][vc_column_text css_animation=&#8221;fadeIn&#8221;]<\/p>\n<h2>Ce sunt &#8222;impozitele&#8221; \u00een Fran\u021ba \u0219i cine le pl\u0103te\u0219te?<\/h2>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;1\/2&#8243;][vc_single_image image=&#8221;35389&#8243; img_size=&#8221;large&#8221; css_animation=&#8221;fadeIn&#8221;][\/vc_column][vc_column width=&#8221;1\/2&#8243;][vc_column_text css_animation=&#8221;fadeIn&#8221;]Impozitele sunt definite ca fiind sume percepute de administra\u021biile publice asupra persoanelor fizice \u0219i \u00eentreprinderilor, direct sau indirect, la nivel na\u021bional sau local, precum \u0219i asupra actelor de cump\u0103rare\/v\u00e2nzare, produc\u021bie, transfer sau mo\u0219tenire.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]Se pot distinge diferite tipuri de impozite:<\/p>\n<ul>\n<li>Contribu\u021biile sociale;<\/li>\n<li>Pl\u0103\u021bi obligatorii c\u0103tre agen\u021bi economici, al\u021bii dec\u00e2t administra\u021biile publice;<\/li>\n<li>Pl\u0103\u021bi, obligatorii sau nu, efectuate c\u0103tre administra\u021biile publice \u00een schimbul unor servicii al c\u0103ror pre\u021b nu este dispropor\u021bionat fa\u021b\u0103 de costul lor.<\/li>\n<\/ul>\n<p>De asemenea, se pot face mai multe distinc\u021bii \u00eentre:<\/p>\n<ul>\n<li>Impozite na\u021bionale \u0219i locale;<\/li>\n<li>Impozite directe, cum ar fi impozitul pe venit, \u0219i impozite indirecte, cum ar fi taxa pe valoarea ad\u0103ugat\u0103;<\/li>\n<li>Impozit propor\u021bional (aceea\u0219i cot\u0103 de impozitare pentru to\u021bi contribuabilii) \u0219i progresiv (cota cre\u0219te odat\u0103 cu valoarea impozabil\u0103).<\/li>\n<\/ul>\n<p>Orice \u201eagent economic\u201d, adic\u0103 orice persoan\u0103 fizic\u0103 sau juridic\u0103 implicat\u0103 \u00een economia francez\u0103, trebuie s\u0103 pl\u0103teasc\u0103 impozit \u00een Fran\u021ba.<br \/>\nAgen\u021bii economici care pl\u0103tesc impozitul sunt denumi\u021bi \u201e\u201dpl\u0103titori\u201e\u201d, iar cei care pl\u0103tesc impozitul sunt denumi\u021bi \u201e\u201dcontribuabili\u201e\u201d. Pentru a le ob\u021bine, exist\u0103 mai multe condi\u021bii care trebuie \u00eendeplinite:<\/p>\n<p>Un lucr\u0103tor temporar trebuie s\u0103 fi lucrat cel pu\u021bin 130 de zile sau 910 ore \u00een ultimele 24 de luni (prelungite la 36 de luni pentru angaja\u021bii cu v\u00e2rsta de peste 53 de ani);<\/p>\n<ul>\n<li>S\u0103 ave\u021bi sub 60 de ani, \u00een caz contrar nu ve\u021bi fi desp\u0103gubit dup\u0103 65 de ani;<\/li>\n<li>S\u0103 nu fi demisionat (s\u0103 fi p\u0103r\u0103sit voluntar locul de munc\u0103);<\/li>\n<li>S\u0103 fi\u021bi apt din punct de vedere fizic pentru munc\u0103: dac\u0103 sunte\u021bi bolnav, nu vi se pl\u0103te\u0219te indemniza\u021bia de \u0219omaj, dar pute\u021bi primi o indemniza\u021bie zilnic\u0103 din partea asigur\u0103rilor de s\u0103n\u0103tate.<\/li>\n<li>\u00cenregistrarea ca persoan\u0103 aflat\u0103 \u00een c\u0103utarea unui loc de munc\u0103 sau \u00een formare: obliga\u021bia de a men\u021bine o \u00eenregistrare regulat\u0103 la P\u00f4le emploi.<\/li>\n<li>S\u0103 c\u0103uta\u021bi \u00een mod activ un loc de munc\u0103: pentru persoanele de peste 55 de ani, este posibil s\u0103 ob\u021bine\u021bi o scutire \u00een func\u021bie de presta\u021biile pe care le ve\u021bi primi.<\/li>\n<\/ul>\n<p>Indemniza\u021bia este calculat\u0103 pe baza salariului dumneavoastr\u0103 anterior, sub rezerva condi\u021biilor de la P\u00f4le emploi, iar indemniza\u021bia se nume\u0219te ARE (Aide au Retour \u00e0 l&#8217;Emploi).<br \/>\nCu toate acestea, unele elemente nu sunt luate \u00een considerare pentru calcularea compensa\u021biei:<\/p>\n<ul>\n<li>plata concediului de odihn\u0103 ;<\/li>\n<li>indemniza\u021bii de nesiguran\u021b\u0103 a locurilor de munc\u0103.<\/li>\n<\/ul>\n<p>Durata indemniza\u021biei se calculeaz\u0103 \u00een func\u021bie de durata activit\u0103\u021bii angajatului. Durata maxim\u0103 a indemniza\u021biei se calculeaz\u0103 \u00een func\u021bie de v\u00e2rsta angajatului. Perioadele luate \u00een considerare de P\u00f4le emploi sunt cele care nu au fost deja utilizate pentru a crea drepturi.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_single_image image=&#8221;35347&#8243; img_size=&#8221;large&#8221; css_animation=&#8221;fadeIn&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text css_animation=&#8221;fadeIn&#8221;]<\/p>\n<h2>Cum func\u021bioneaz\u0103 securitatea social\u0103 pentru lucr\u0103torii temporari?<\/h2>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;1\/2&#8243;][vc_column_text css_animation=&#8221;fadeIn&#8221;]Fiecare angajat temporar are dreptul la un sistem de pensii, finan\u021bat par\u021bial de agen\u021bia de ocupare a for\u021bei de munc\u0103. Rolul acestui sistem este de a compensa pierderile de venit \u00een caz de \u00eentrerupere a activit\u0103\u021bii. Cette indemnisation peut \u00eatre compl\u00e9t\u00e9e par le r\u00e9gime de pr\u00e9voyance du salari\u00e9.
